There is a lot of malware that can seriously mess up your devices. Please make sure that you download only content from sources you trust. You are in control and this is why we are not responsible of how you use the software.
The services that LinkoTec provides to you are subject to the following Terms of Use ("TOU"). LinkoTec reserves the right to update the TOU at any time without notice to you. The most current version of the TOU can be reviewed by clicking on the "Terms of Use" hypertext link located at the bottom of Dazzboard Web pages. The Dazzboard Software is protected by copyright and/or other applicable law. Any use of the Software other than as authorized under these terms of use or copyright law is prohibited. By exercising any rights to the Software provided here, you accept and agree to be bound by the terms of this agreement.
The Conditional access services are offered periodically by third party vendors or Content Providers. The Plug-in Software enables You to access Conditional Access services (like music downloads) only if You have a eligible device connected to Your computer and have the latest version of the Plug-in Software installed. After accepting these Terms of Use, you are free to download and install the Plug-in Software and LinkoTec hereby grants You a worldwide, royalty-free, non-exclusive, perpetual license to install and run the Plug-in Software on your computer. The Plug-In software contacts the Server Software to verify that the user is allowed to access the content. The Content Provider may enable downloads after receiving a confirmation from the Server Software. LinkoTec is not liable for the Content Providers' services or for the content that is delivered by the Content Provider unless otherwise stated. Some features of the service are available only to registered users. The server software may store information about the user downloads and devices connected to the user's computer. As a condition of your use of the Services or Plug-in Software, you will not use the Services or Plug-in Software for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services or Plug-in Software in any manner that could damage, disable, overburden, or impair any LinkoTec server, or the network(s) connected to any LinkoTec server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any LinkoTec server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services or Plug-in Software. LinkoTec respects the intellectual property of others, and we ask our users to do the same. Compliance with copyright laws remains your responsibility. LinkoTec, may, in appropriate circumstances and at its discretion, terminate the Dazzboard services and block users' accounts of users who infringe upon the rights of others. Pursuant to section 22 of Laki tietoyhteiskunnan palvelujen tarjoamisesta, notifications of claimed copyright infringement should be sent to LinkoTec. Disclaimers of Warranties and Limitations of Liability You understand and agree that any material, including but not limited to the Software, required or automated updates, modification, reinstallations, or Software otherwise obtained through the use of the Service is done at your own discretion and risk and that you will be solely responsible for any damages or loss of data to your computer system or portable devices that may result from any such material. LinkoTec is not responsible for any content such as audio, video, text or any other file owned by users of the Dazzboard software. Dazzboard software, its privacy and security features are exposed to various security issues, and should be regarded as unsecured. Therefore by using the Dazzboard software you may be subject to various risks, including the exposure of information and material you have downloaded or have offered to share. The Software is provided on an "as is" basis and on an "as available" basis. LinkoTec makes no representations or warranties of any kind with respect to the Software, its contents, or services that require the Software to work, and disclaims all such representations and warranties, including, without limitation, warranties of merchantability and fitness for a particular purpose, non-infringement of third party rights, error-free or uninterrupted service, accuracy, availability, reliability, security, currency and completeness arising from or relating to the Software. In no event shall LinkoTec, any officer, affiliate, director, shareholder, agent, principal, contractor or employee of LinkoTec be liable for any indirect, special, incidental, consequential, punitive or aggravated damages (including without limitation damages for loss of data, income or profit, loss of or damage to property and third party claims), arising out of or in connection with the software or services offered through, contained in or advertised on LinkoTec's website or through any link provided on LinkoTec's website ; whether or not LinkoTec has been advised of the possibility of such damages. This exclusion of liability shall apply to the fullest extent permitted by law.
If any provision of these Terms of Use is invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the terms, and without further action by the parties to this agreement, such provision shall be reformed to the minimum extent necessary to make such provision valid and enforceable. These Terms of Use constitute the entire agreement between the parties with respect to the LinkoTec's Software and services. There are no understandings, agreements or representations with respect to the the LinkoTec's Software and services not specified here. LinkoTec shall not be bound by any additional provisions that may appear in any communication from You. This Agreement shall be construed and interpreted in accordance with the laws of Finland, excluding its rules for choice of law. Any claim or dispute between You and LinkoTec that arises in whole or in part from the LinkoTec's Software or services shall be decided exclusively by a court of competent jurisdiction located in Helsinki, Finland.
